In consideration of being allowed to enter, use the play area, utilize the equipment, or participate in any event, party, or program at Eden’s Play Café, the undersigned acknowledges, agrees, and accepts the following terms on behalf of themselves and any minor(s) listed below:

1. Assumption of Risk

I understand and acknowledge that the play area, play equipment, and café environment contain inherent risks of injury, including but not limited to scrapes, bruises, cuts, falls, collisions, sprains, fractures, concussions, and even more serious injuries such as paralysis or death.

I voluntarily assume all risks associated with participation in activities at Eden’s Play Café, including risks resulting from the negligence of other participants, employees, or third parties. I further acknowledge that Eden’s Play Café cannot eliminate all risks or guarantee the safety of participants.

2. Waiver of Liability

I, on behalf of myself, my minor child(ren), and our respective heirs, assigns, administrators, personal representatives, and next of kin, fully and forever waive, release, discharge, and hold harmless Eden’s Play Café, its owners, officers, employees, agents, affiliates, landlords, vendors, and other participants from any and all claims, liabilities, damages, costs, or legal actions arising out of or related to injury, loss, or damages sustained while on the premises, including but not limited to those arising from negligence.

3. Parental Responsibility & Supervision

I acknowledge that Eden’s Play Café does not provide supervision for children and that I, as the parent or legal guardian, am solely responsible for the safety, well-being, and conduct of my minor child(ren) at all times while on the premises.

I agree to actively supervise my child(ren) and ensure they follow all stated rules, safety signs, and verbal instructions from Eden’s Play Café staff.

I accept full responsibility for any damages to the facility, equipment, or other property caused by my child(ren) due to negligent, reckless, or intentional actions.

4. Rules & Compliance

I agree that my child(ren) and I will comply with all posted rules, terms, and safety guidelines as a condition of entry and participation. If I observe any hazard or unsafe condition, I will immediately report it to a staff member.

5. Health & Wellness Agreement

I confirm that neither I nor my child(ren) have exhibited symptoms of any contagious illness (including but not limited to COVID-19, flu, or other communicable diseases) within the last 14 days.

I understand that participation in public spaces carries the risk of exposure to illness, including COVID-19, and I assume all risks associated with such exposure.

I hereby release Eden’s Play Café from any liability related to illness or health concerns contracted while at the facility.

6. Indemnification & Hold Harmless Agreement

I agree to indemnify, defend, and hold harmless Eden’s Play Café from any and all claims, actions, damages, or expenses arising from my or my child(ren)’s participation in activities at the facility. This includes but is not limited to attorney’s fees and costs associated with claims brought by any third party.

7. Agreement to Terms

I certify that I am the parent or legal guardian of the minor(s) named below and have the authority to sign this waiver on their behalf. I have carefully read and understand the terms of this Participation Agreement, Liability Waiver, and Hold Harmless Agreement and voluntarily agree to its terms. I understand that this agreement remains in effect indefinitely and applies to all future visits.

Photo Media Release

8. I grant Eden’s Play Café permission to use any photographs, videos, or media captured of me or my child(ren) while on the premises for marketing, social media, and promotional purposes. I understand that no compensation will be provided for the use of such images.
